Compliance requirements
The tenderer must confirm that none of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply to it. In plain terms, this means there must be no relevant convictions of the company’s management or representatives, no illegal employment-related offences, no child labour or human trafficking offences, no tax or social security debt, and no conflict with international or Government sanctions. The machine-readable notice did not include any more detailed exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another equivalent register in its country of establishment; for bidders registered in Estonia, the contracting authority checks the data itself, while a foreign bidder must submit a copy of a valid registration certificate. The bidder and/or its subcontractor must have performed at least one contract similar to the subject of the procurement, related to the installation or upgrade of video systems, within the 36 months before the start of the procurement, and must submit Form 2, the list of contracts, with dates and contracting parties. The persons responsible for carrying out the work must have the competence of a security systems technician, level 4, or equivalent; a foreign bidder must provide the relevant qualification and competence documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. The bid must comply with all tender document requirements; alternative, conditional or partial bids are not permitted. The bid price must be submitted in the structure prescribed in Form 1.
