Compliance requirements

The bidder must confirm that neither it nor its management, supervisory or controlling body members, procurators, or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, the commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may provide a description and evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are linked to the Russian Federation in the manner described in the sanctions rules. In addition, the bidder must confirm that it will not use a subcontractor that would have to be replaced under section 122(7) of the Public Procurement Act. In the case of a joint bid, a power of attorney and the lead joint bidder must be identified. Conditional bids are not allowed.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its home country, or in an equivalent register if required by the law of that country. An Estonian bidder must be in the Commercial Register; a foreign bidder must explain why it is not entered in the required register and provide registration details or evidence if requested by the contracting authority. The bidder’s average annual net turnover for the last two completed financial years before the start of the procurement must be at least EUR 800,000 in each year for the period 01/01/2023–31/12/2024. Joint bidders may combine their turnover figures. The bidder or joint bidder must have experience in designing and constructing similar infrastructure. The bidder or joint bidder must also have, within the 60 months before the start of the procedure, experience of constructing at least one asphalt-concrete facility larger than 4,500 m2 under CPV code 45200000-9. The work must have been completed by the date of publication of the contract notice and carried out properly and in accordance with good practice. The bidder must submit in the ESPD a list of the relevant construction contracts and, if needed, evidence of proper performance.
