Compliance requirements
The contracting authority will exclude a bidder or applicant if they are bankrupt, being liquidated or reorganised, if insolvency, liquidation or reorganisation proceedings have been opened against them, if their business activity is suspended, or if they are in a similar situation under the law of their country of establishment. The bidder or applicant must provide a written confirmation that these circumstances do not apply (Form I).
The contracting authority will also not conclude the contract with a person who has tax or social security payment arrears, including interest on unpaid amounts, as of the contract award date. In this notice, tax debt means unpaid state or social security taxes and interest exceeding EUR 100. The contracting authority checks this itself during bid evaluation. If the bidder is a tax resident outside Estonia, the bidder must submit the necessary extracts from the tax register of the country of establishment or another equivalent source.
