Compliance requirements

The contracting authority will exclude a bidder or applicant if any of the exclusion grounds under Section 95(1) points 1 to 5 of the Estonian Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or breach of conditions for employing foreigners in Estonia, including payment of wages below the statutory minimum; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where awarding the contract would breach an international sanction or a sanction of the Government of Estonia. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment if that is required by the laws of that country. A bidder established in Estonia does not need to submit a register extract for Estonian business register registration. The bidder and/or its subcontractor must have completed at least 1 similar contract in the 60 months before the start of the procurement. The contract must have involved electrical installation works, including installation, reconstruction or replacement of battery packs and/or other direct current systems. The bidder must submit a list of the main contracts completed in that period, with the contract name, short description, performance period and the other contracting party, using Form 2. The bidder and/or its subcontractor must have qualified responsible persons for the works, including an electrical works supervisor with at least B-class competence certificate or equivalent. The bidder must submit the list of responsible specialists using Form 3 and copies of documents proving their qualifications and competence. A foreign bidder may submit equivalent qualification documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above responsible person. The bid must also include the required bid form, technical data for the offered equipment and materials, and confirmation that the bid complies with the tender documents. If the bidder relies on equivalent solutions, the equivalence must be explained and supporting evidence must be attached.
