Compliance requirements
The bidder must not be bankrupt or in liquidation, nor may bankruptcy or liquidation proceedings have been initiated against it, and its business must not be suspended or in a similar situation. The bidder must not have debts for state taxes, fees, environmental charges or social security contributions, unless the debt has been deferred or paid within the required deadline.
No exclusion grounds under Section 95(1)(1–3 and 5) of the Public Procurement Act may apply to the bidder. If the tax authority check cannot be carried out, the contracting authority may request evidence issued no more than two weeks before the tender submission deadline. If the bidder does not submit the required evidence within 10 calendar days, it may be excluded from the procedure.
The bidder and the technical consultant advising the reconstruction of the apartment building for the contracting authority must not be related persons. In a joint bid, the exclusion grounds are checked separately for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register for construction activities covering general building works, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have the electrical works registration for construction of electrical installations, including installation. The registration requirement does not apply to a foreign bidder, which may prove equivalent competence instead.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro.
Within the last 60 months, the bidder must have completed at least one equivalent construction project worth at least half of the estimated contract value. An equivalent project means construction, extension or full-building reconstruction as the main contractor, including at least structural and external envelope works, heat-recovery ventilation works, and heating system or new heating system works. To prove the reference, the bidder must provide either the building register notice/use permit number or a handover-acceptance certificate signed by the client and contractor.
The bidder’s team must include a project manager with at least level 6 professional qualification as a building engineer specialising in building construction and with competence in managing construction activities, or a level 6 construction manager qualification specialising in general construction. A foreign bidder may provide an equivalent qualification. The project manager must be involved in the performance of the works. The tender documents also contain requirements for the site manager and other roles; the exact role and competence requirements must be checked in the tender documents.
The bid must be submitted by the bidder’s legal representative or an authorised representative. In a joint bid, the joint bidders must appoint an authorised representative, state each party’s share and nature of performance, and attach a joint power of attorney. If team members are not the bidder’s employees, written consent from each such person must be attached. The bid form must be submitted on the contracting authority’s form.
