Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD under Section 95 of the Public Procurement Act. The bidder or members of its management bodies must not have been finally convicted of these offences within the last five years, or the disqualification period set out in the conviction must still apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures to restore reliability. The machine-readable notice did not set out all exclusion grounds in full; the remaining grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least 3 similar service contracts during the last 36 months. A similar service means transporting motor vehicles, including mopeds, electric cars, off-road vehicles, robot vehicles and vehicles with a manufacturer’s speed below 6 km/h, on a tow truck and towing them to a guarded storage location. The bidder must provide a confirmation in the ESPD and may add a list of completed contracts with their value, dates of conclusion and details of the other contracting party; the contracting authority may verify the information from public registers and, if necessary, request additional explanations or documents within 5 working days. To perform the service, the bidder must have at least 2 tow trucks: one capable of towing a vehicle with a gross mass of up to 3,500 kg and one capable of towing a vehicle with a gross mass of up to 40,000 kg. The bidder must submit the tow truck details, copies of the technical registration certificates and, where applicable, a consent from another company to use the tow truck(s). The tender must comply with the technical specification, be unconditional, and include the price breakdown on the contracting authority’s form and a 24/7 order reception phone number. In the case of a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also confirm compliance with the tender documents and that subcontractors and suppliers linked to the Russian Federation will not account for more than 10% of the contract value.
