Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, evidence of self-cleaning measures must be provided where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, or submit a copy of the deed of incorporation or an equivalent document if there is no registration obligation. To submit the tender, the bidder must provide the HD Annex 3 Form I declaration and, if needed, a power of attorney for representation; in a joint tender, a joint power of attorney must also be submitted. The tender must remain valid for at least 3 months. For the offered products, the bidder must submit the HD Annex 1 technical specification and price form, an Estonian product catalogue or information material with indications for use and nutrient content, and, if necessary, additional information proving compliance with the technical specification. The bidder must confirm that the tender complies with the procurement documents, that conditional tenders are not allowed, and that it will provide, if needed and at no extra cost, an introduction to the products and the manufacturer’s instructions for use as well as staff training before the products are put into use. For home enteral nutrition patients, the bidder must be ready to sign a cooperation agreement regulating ordering, transport, handover, acceptance and prices.
