Compliance requirements
Mandatory exclusion grounds: the bidder is excluded if it, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, financing of terrorism, enabling illegal employment, illegal use of child labour, or trafficking in human beings. Exclusion also applies if the bidder has tax, duty or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. Voluntary exclusion grounds: the bidder may be excluded if it has seriously or repeatedly breached a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed, or if it has provided false information about meeting the qualification requirements or failed to submit required data or additional documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, including at least one contract worth at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, showing the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address), and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or its own databases without significant effort. The team must also include a person in charge of electrical works with valid A-competence and/or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant proof at the time of bid submission and is entered in Elektrilevi’s partner portal before the bid submission deadline. There must also be a person appointed as responsible for the work operation, entered in the partner portal before the bid submission deadline. For switching operations in the 0.22–20 kV electricity network, the team must include a person with valid switching rights entered in the partner portal before bids are opened; if only low-voltage works are procured, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. The bid must comply with the tender documents, include the required price table, and provide representation-authority details; in a joint bid, a joint bidders’ power of attorney must be attached.
