Compliance requirements

The tenderer must confirm that none of the exclusion grounds under Section 95(1), Section 95(4)(8) and Section 95(4^1) of the Public Procurement Act apply. If the tenderer relies on another company’s resources, that company must also have no exclusion grounds.

Qualification criteria and exclusion grounds

The tenderer must provide details of at least one contract completed within the 60 months before the start of the procurement, where a rail track, including a tram track or railway, was designed at the detailed design stage. The reference contract may have been signed earlier, but the finished project must have been handed over to the client and accepted by the client within the last 60 months. The contracting authority may request confirmations from the other contract party. The person responsible for managing the design work must hold at least the qualification of a chartered road engineer or an equivalent EQF qualification at level 7 or higher (excluding initial qualification) in the field of design management. The same person may also act as the person responsible for the design work if both role requirements are met. The person responsible for the design work must hold at least the qualification of a chartered road engineer or an equivalent EQF qualification at level 7 or higher (excluding initial qualification) in the field of road construction design. The same person may also act as the design project manager if both role requirements are met. The bid must be submitted by the tenderer’s legal representative or an authorised person. In a joint tender, the joint tenderers must appoint an authorised representative, submit a power of attorney and provide confirmation from all joint tenderers that no exclusion grounds apply. If the tenderer relies on the resources of another undertaking, it must submit that undertaking’s consent, its details regarding fulfilment of the selection criteria and confirmation that no exclusion grounds apply. The tender must comply with the procurement documents, conditional tenders are not allowed, and the tender price must be submitted in the required structure. If equivalent solutions are used, equivalence must be explained and supporting evidence must be attached. The tenderer must also submit a calculation of how the design work price is formed by work item and cost item.
