Compliance requirements
The bidder must confirm the absence of exclusion grounds on the prescribed confirmation form. The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another authorised representative, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing; if they have been convicted of enabling work for an illegally staying foreign national or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; if they have been convicted of illegal use of child labour or trafficking in human beings; if the bidder has tax, duty or environmental charge arrears, or social security contribution arrears under the law of its country of establishment; or if awarding the contract would breach an international sanction or a Government of the Republic sanction under the International Sanctions Act.
The contracting authority may also exclude a bidder that has materially or repeatedly breached an earlier public contract so that the contract was terminated, rescinded, the price was reduced, damages were compensated or a contractual penalty was paid, or that has submitted false information about the absence of exclusion grounds or compliance with the qualification requirements, or has failed to submit the required data or additional documents.
In a joint tender, all joint bidders must submit the confirmations and complete the relevant fields on the prescribed form.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. On request, the bidder must provide a copy of a valid registration certificate; bidders established in Estonia do not need to submit it.
If the bidder relies on the capacities of another entity to meet the economic/financial or technical/professional requirements, the bidder must provide the relevant details in the confirmation form and also submit the confirmations of that other entity.
Net turnover must have been at least EUR 300,000 per year, excluding VAT, in each of the last three completed financial years before the start of the procurement (2023, 2024 and 2025). If the financial year does not run from 1 January to 31 December, the turnover data must be given for the bidder’s corresponding financial periods. The bidder must provide the turnover data in the confirmation form and, on request, supporting financial statements or other evidence.
Within the 36 months before the start of the procurement, the bidder must have properly completed at least 2 similar construction and/or repair contracts with a total value of at least EUR 200,000 excluding VAT. Similar contracts are defined as construction and/or repair works for electric lines. The bidder must provide the contract details in the confirmation form and, on request, a client confirmation that the works were carried out without material breaches.
For contract performance, the bidder must involve an electrical works project manager who has at least one of the following professional qualifications: electrical field B-competence class or equivalent; or Electrical Engineer, level 6 (specialisation: electrical networks and systems; competence: construction and operation of primary equipment of the electrical network); or equivalent. The bidder must provide the project manager’s details in the confirmation form. If the certificate cannot be verified through the public register of the Estonian Qualifications Authority, a copy of the certificate must be submitted on request. If the team member is not the bidder’s employee but is engaged through reliance/subcontracting, the bidder must also submit that person’s confirmations on the absence of exclusion grounds and willingness/ability to participate in contract performance. If the qualification certificate was issued abroad, it must have undergone the required recognition/checking procedure by the competent Estonian authority, or the bidder must provide proof that an application for recognition has been submitted. The certificate or its recognition must remain valid for the entire contract period.
