Compliance requirements
The bidder must be excluded if the bidder, or a member of its management, administrative or supervisory body, a procurator, or another authorised representative, has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, financing of terrorism, illegal use of child labour, or human trafficking. Exclusion also applies if the bidder has tax, fee or environmental charge arrears, or arrears of taxes or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, or has submitted false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works do not originate from Russia or Belarus.
Qualification criteria and exclusion grounds
Over the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts showing the performance period, the other contracting party’s details, including the client representative’s contact details, and, in the case of public procurements, the reference numbers. On the contracting authority’s request, evidence of proper performance must be submitted unless the authority can obtain the information from public or its own databases without major expense. In addition, the bid must include the price table, and the bidder’s team must include the required electrical-work-related roles: a person with switching rights, a person responsible for the work operation (C-person), and a leading electrical works person with valid A-competence or at least level 6 qualification who is registered in Elektrilevi’s partner portal before the bid deadline. If the right of representation does not arise from the articles of association, a power of attorney must be included. In the case of a joint bid, a joint bidders’ power of attorney must be attached. The bid must comply with the tender documents, and alternative or conditional bids are not allowed.
