Compliance requirements
The bidder must confirm that neither the bidder nor the members of its management body have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the completed technical specification form (Annex 1) and the documents required in it so that the contracting authority can verify compliance of the products. The completed price form (Annex 2) must also be submitted; in case of any discrepancy, the contracting authority will rely on the price form. The tender must comply with the requirements set out in the procurement documents and, where necessary, equivalent-means evidence must be attached. In addition, the bidder must confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value who are linked to the Russian Federation under the sanctions rules. If the bid is submitted jointly, a power of attorney for the joint bidders must be attached. If the exact qualification requirements are not stated in the machine-readable notice, they must be checked in the tender documents.
