Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: criminal convictions of the bidder’s management or authorised representatives for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of foreign nationals or breaches of wage rules; child labour or human trafficking offences; tax, environmental, social security or similar arrears in the bidder’s home country; or if awarding the contract would breach an international or Government of the Republic of Estonia sanction.
Qualification criteria and exclusion grounds
The bidder or its subcontractor must have successfully performed at least one contract of similar complexity and scope to the subject of the procurement, namely an evacuation lighting installation or reconstruction contract, completed within the 60 months preceding the start of the procurement. A list of such contracts must be submitted with their value, dates and the other contracting parties.
There must be a qualified person responsible for the works. For electrical works, at least one person must have an A-class competence certificate or an equivalent or better proof. For construction works, at least one person must have a professional qualification as a construction engineer at least level 6 (excluding the initial qualification) or as a construction manager at least level 5, or equivalent proof. A foreign bidder must submit copies of qualification and competence documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
The bid must comply with all tender document requirements and conditional bids are not allowed. If the tender documents refer to a standard, technical approval, brand, type or similar reference, equivalence must be explained where necessary and evidence of equivalence must be attached. The bidder must submit the completed price form and transfer the total bid price to the form titled “Award criteria and evaluated indicators”.
