Compliance requirements
The bidder must confirm that neither it nor its management body members have been finally convicted within the last five years for the offences listed in the procurement documents, including participation in a criminal organisation, corruption, fraud, and offences related to terrorist acts or terrorist activities. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for the last three financial years (2023, 2024 and 2025) must be at least EUR 40,000. In a joint tender, the figures may be aggregated. Within the last 36 months, the bidder must have performed at least 2 contracts of a similar nature, each lasting at least 6 months; a similar contract is one that included at least two transport services for pupils with special needs. The bidder must provide a list of those contracts and, where necessary, the client’s confirmation or the public procurement reference number. The driver must have at least 3 years of experience driving the relevant vehicle, no traffic-related penalties in the last 2 years, and training in transport of persons with special needs and safety in transporting groups of children; at least 2 years of experience in transporting children with special educational needs is recommended. By the start of the service, the carrier must have liability insurance of at least EUR 300,000 per claim, and the registered business activity in the commercial register must be passenger transport or an equivalent activity. In a joint tender, the joint bidders must appoint an authorised representative. The tender must comply with all tender document requirements, and conditional tenders are not allowed.
