Compliance requirements

The contracting authority will exclude a bidder if mandatory exclusion grounds apply, including convictions of the bidder or its management/representation bodies for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to enabling illegal employment of a foreign national or violating conditions of employment in Estonia, including payment below the statutory wage rate; offences related to illegal use of child labour or human trafficking; or outstanding tax, duty or environmental charge debts, or tax/social security contribution debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract that led to termination, price reduction, damages or contractual penalty, or if the bidder has provided false information about compliance with qualification requirements or failed to submit required additional documents. The bidder must confirm that none of these mandatory or voluntary exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, details of the other contracting party (including the client representative’s contact details, telephone and e-mail address) and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided unless the authority can obtain the information from public or its own databases without significant cost. The bid must also include the completed price table. The bidder must have a person managing electrical works with a valid A-competence or, under the Vocational Education Act, at least level 6 qualification; the person must hold the relevant certificate at the time of submission and be entered in the EPP environment before bid opening. The bidder must also have a person with valid switching rights for switching operations in the 0.22–20 kV electricity network; for low-voltage works at least MV switching rights are sufficient, otherwise both MV and HV switching rights are required. The bidder must have a person designated as responsible for work operations, entered in the EPP environment before bid opening. The bidder must provide the names, job titles and contact details of the contract signatory(ies) and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm that it is not established in the Russian Federation or the Republic of Belarus and that materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The bid must also state any business secrets or confirm that none are included.
