Compliance requirements
The bidder is excluded if a mandatory exclusion ground applies to the bidder or to a managing, supervisory or representative person: conviction for participation in a criminal organisation, corruption, fraud, a terrorism-related offence, money laundering or terrorist financing; conviction for enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia; conviction for illegal use of child labour or human trafficking; or tax, fee or environmental charge arrears. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract or for providing false information about qualification or failing to submit required data and documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, information about the other contracting party, and, in public procurement cases, the reference number. Upon request, the contracting authority must be provided with evidence of proper performance of the similar electrical construction contracts. In addition, the bidder must have an electrical works manager with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant certificate at the time of submission and has been entered into the EPP environment before the opening of tenders.
