Compliance requirements
The mandatory exclusion grounds are standard: the bidder is excluded if it or a member of its management, administrative or supervisory body, or its proxy or other authorised representative, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing; if it has been convicted of enabling the employment of a foreign national staying in the country without legal basis or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage; if it has been convicted of illegal use of child labour or human trafficking; or if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder voluntarily if it has seriously or repeatedly breached an essential term of a previous public contract, or if it has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, including at least one contract worth at least EUR 40,000 excluding VAT. The bidder must submit a list of contracts showing the performance period, the other contracting parties with the client representative’s contact details, and procurement reference numbers where applicable. On request, the bidder must provide evidence that the similar electrical construction contracts were performed properly, unless the contracting authority can obtain the information from public or its own databases without significant cost. In addition, the bidder must have a person in charge of electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, with the relevant proof available at the time of bid submission and entered into the EPP environment before bid opening. The bidder must also have an employee with switching authorisations for work-related switching in the 0.22–20 kV electrical network; for low-voltage works only, at least low-voltage switching authorisations are sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required. The bidder must also have a designated person responsible for work operations, entered into the EPP environment before bid opening. The bid must be submitted with a completed price table. The bidder must provide the names, job titles and contact details of the signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm the standard payment term chosen by the contracting authority and, if applicable, take into account the 95-calendar-day payment term linked to the factoring programme.
