Compliance requirements
The bidder must be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence, an offence related to terrorism, money laundering, financing of terrorism, enabling illegal employment, violating the conditions of employment of a foreign national, or unlawful use of child labour or trafficking in human beings. Exclusion also applies if the bidder has tax, fee or environmental charge arrears, or arrears of tax or social security contributions under the law of the country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, or that has submitted false information about qualification or failed to provide the required information or documents. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurements, the reference numbers. On request, the contracting authority may require evidence that the similar electrical construction contracts were performed properly. In addition, the bid must comply with the tender documents, and the bid price must be submitted in the required table with all unit price fields completed. The bidder must have a worker with valid switching rights for switching operations related to the works, a person designated as responsible for the work operation, and a person managing electrical works who has valid A-level competence or at least level 6 qualification under the Occupational Qualifications Act and the relevant certificate. These persons must be entered in the EPP environment before the opening of tenders. The bidder must also provide the names and contact details of the contract signatory and the contact person for contract performance, and, if necessary, a power of attorney.
