Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing. Exclusion also applies if such persons have been convicted for enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage, or for illegal use of child labour or trafficking in human beings. A bidder is also excluded if it has tax, fee or environmental charge arrears, or arrears of taxes or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has provided false information about qualification conditions or failed to submit required information or documents. Companies whose place of residence or establishment is in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them worth at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details, telephone number and email address) and, in public procurement cases, the reference numbers if available. The contracting authority may request evidence of proper performance if it cannot obtain the information from public or its own databases without major effort. In addition, the bidder must have an electrical works manager with valid A-competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, with a relevant certificate at the time of submission and added to Elektrilevi’s partner portal before opening of tenders. The bidder must also have an employee with switching rights for switching operations in the 0.22–20 kV electricity network related to the works, a designated person responsible for work operations, a contract signatory and contact person, and the price table completed in the form required by the tender document. The bid must comply with all tender document conditions, and alternative or conditional bids are not allowed.
