Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including convictions for participation in a criminal organisation, corruption and fraud. The notice also requires confirmation regarding the use of subcontractors and suppliers subject to the EU Russia sanctions restriction: the bidder must not involve subcontractors or suppliers exceeding 10% of the contract value if they are Russian nationals, residents, entities established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives acting on their instructions. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 400,000. Joint bidders may aggregate turnover. The bidder must enter the turnover data in the ESPD and, on request, provide an annual report extract or other evidence. If the bidder relies on another entity’s resources, the bidder must also provide that entity’s details and, if requested, its consent and evidence of turnover.
For technical and professional capacity, the bidder must have properly performed at least 1 contract for design of a public road construction project within the 36 months before the start of the procurement. A list of such contracts must be provided, including their value, dates and the other contracting parties. On request, the bidder must provide a client confirmation that the contract was performed properly and that a public road construction project was prepared under it, including the completion deadline and the value excluding VAT. If the bidder relies on another entity’s capacities, the bidder must also provide that entity’s details and, if requested, its consent and participation in direct performance of the contract.
