Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent, decide for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or incitement, aiding or attempting such an offence, money laundering or terrorist financing. Exclusion also applies if such persons have been convicted of enabling work by a foreign national staying illegally in the country or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage, or of illegal use of child labour or human trafficking. The bidder is also excluded if it has tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, if the breach led to withdrawal from the contract, termination, price reduction, damages or contractual penalties, or if the bidder has submitted false information about compliance with qualification requirements or failed to submit required additional documents. The bidder must confirm that none of these mandatory or voluntary exclusion grounds apply. Bidders whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the tender, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information on the other contracting parties (including the client representative’s contact details, such as phone number and email address), and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder’s team must also include a person with valid switching rights for 0.22–20 kV electrical networks, entered in Elektrilevi’s partner portal before the deadline for submitting tenders, and a person responsible for the work operation who is also entered in the partner portal before the deadline. In addition, the team must include a person managing electrical works who has valid A-competence and/or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, has the relevant proof at the time of submission, and is entered in the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include a completed price table in the required form, and all unit price fields in the table must be filled in. The bidder must confirm that the bid complies with the tender documents and that no conditional or additional offer is submitted.
