Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that its business activities are not suspended, and that it has no tax or social security contribution debts. The bidder must also confirm that the average salary of its employees was above 70% of the average salary in the relevant sector during the reference period, and that it is not a related person to the beneficiary’s technical consultant. Proof of the average salary must be provided with a Tax and Customs Board extract or, for a foreign bidder, equivalent evidence from a competent authority.
Qualification criteria and exclusion grounds
The bidder must have filed a notice in the business register under the construction activity for general building works, indoor climate systems, and building-internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration notice for electrical works covering the construction or installation of electrical installations; for a foreign bidder, an equivalent proof is sufficient. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must also be able to provide a performance security of 5% of the contract value by the contract date at the latest, or within 10 calendar days after signing. As for prior experience, the bidder must have carried out at least one equivalent construction project during the previous 60 months, with a value of at least half of the estimated contract value excluding VAT; the project had to involve the construction, extension or full reconstruction of a building as the main contractor and include load-bearing and external envelope works, heat-recovery ventilation, and a new heating system. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage specialist, a person qualified for electrical works, and an authorised architect responsible for compliance with the European New Bauhaus requirements; for each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The tender must comply with the procurement documents, conditional tenders are not allowed, the beneficiary’s tender form must be used, and where applicable the bidder must submit a joint bid power of attorney, proof of representation, and documents proving equivalence.
