Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory board members, procurators or other authorised representatives have been finally convicted in the last five years for participation in a criminal organisation, corruption, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total annual turnover for each of the last 3 financial years ended by the start date of the relevant procurement must be at least EUR 120,000. The bidder must provide turnover data for the last 3 financial years and, if necessary, an extract from the annual accounts or other proof if the data are not publicly available from official registers.
Within the 36 months before the publication date of the contract notice, the bidder must have completed at least one design contract similar to the subject of the procurement. For a contract to be considered similar, the bidder must have acted as the main contractor, and the designed building or building complex must have had at least 3,000 m2 of enclosed net floor area. The work must have been carried out at least at the preliminary design stage and must have covered the architectural, structural, building services, electrical installation, fire safety and energy efficiency parts.
The bidder’s team must include a project manager with at least level 7 certified civil engineer qualification or level 7 authorised architect qualification, and experience of managing at least one similar design contract as the main contractor’s project manager within the last 36 months. The team must also include an architect with at least level 7 authorised architect qualification and experience as the main contractor’s architect in the design of at least one building or building complex over 3,000 m2 within the last 36 months. The project manager and the architect may not be the same person.
If the professional certificate was issued in Estonia, the contracting authority will check the qualification in the public register of the Estonian Qualifications Authority. If the certificate was issued outside Estonia, the bidder must submit a copy of the document issued by the competent authority and, if requested, proof from the competent Estonian authority that the foreign qualification corresponds to the required qualification. The project manager’s details must be submitted on form Annex 5.2 and the architect’s details on form Annex 5.1. In a joint tender, a power of attorney for the joint bidders must be submitted and the share and nature of each joint bidder’s part of the contract must be stated. The tender must be submitted electronically via eRHR, and by submitting it the bidder confirms acceptance of all tender document conditions. The machine-readable notice did not include precise compliance requirements; they must be checked in the tender documents.
