Compliance requirements
The bidder must confirm that neither it nor the members of its management, representative or supervisory bodies have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must confirm in the tender that the bid complies with the tender documents and that, where necessary, equivalence has been explained and supporting evidence has been attached. The manufacturer’s technical description or documentation of the offered device must be submitted so that compliance can be assessed. The bidder must confirm a warranty of at least 24 months for the supplied goods and ensure warranty repairs at its own expense. In addition, the environmental conditions must be met: the bidder must declare substances on the REACH candidate list above 0.1% by weight for all required components and provide the relevant evidence; it must also describe and, where required, prove how the reuse and recycling service for decommissioned equipment will be organised and on what legal basis waste handling will be carried out. If the bid is a joint tender, a power of attorney for the joint bidders must be attached.
