Compliance requirements
Mandatory exclusion grounds: the bidder must not be linked to offences involving criminal organisation, corruption, fraud, terrorism, money laundering, child labour or human trafficking; it must not have tax debts or breach international or Government sanctions. The bidder must confirm that none of these grounds apply.
Voluntary exclusion grounds: the contracting authority may exclude a bidder if it has breached environmental, social or labour-law obligations, is bankrupt or being wound up, has seriously breached professional rules, has participated in anti-competitive agreements, is in a conflict of interest, has gained an unfair advantage in preparing the procurement, has materially breached previous public contracts, has provided false information, or has acted to influence the contracting authority or obtain confidential information. The bidder must also confirm that no legal restriction prevents it from submitting a tender.
Qualification criteria and exclusion grounds
The bidder's net turnover for each of the last three completed financial years must be at least EUR 2,000,000. If the financial year does not coincide with the calendar year, this requirement applies to the last three completed financial years, and at least six months must have passed since the end of the last completed financial year by the tender submission date. Evidence must be provided by extracts from the reports of the last three completed financial years showing net turnover, unless this information is publicly available to the contracting authority.
The tender must comply with all tender document requirements. The bidder must submit Form 1 price quotation table, Form 2.1 Kunda switchgear 6 kV, Form 2.2 Kunda switchgear 20 kV and Form 3 reserve equipment price table. The technical forms must be completed in full; partial completion may lead to rejection of the tender. For the 6 kV and 20 kV switchgear, the bidder must take into account that from 1 January 2026 medium-voltage switchgear up to 24 kV using SF6 as an insulating or interrupting medium may no longer be placed into service. If both SF6 and SF6-free solutions are offered, separate tenders must be submitted for them. If several SF6-free manufacturers are available on the market, only SF6-free tenders will be evaluated.
The bidder must provide the name(s), job title(s) and contact details of the person(s) signing the contract, as well as the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must be unconditional, and the bidder must confirm acceptance of the tender document terms.
