Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
To make the offer compliant, the bidder must confirm that the bid complies with all tender document requirements and that no conditional offer is submitted. The price offer must be submitted in the structure of the cost form provided by the contracting authority. For the lots, bids may be submitted for up to 3 lots, and a contract may also be awarded to one bidder for up to 3 lots. The compliance conditions also include a requirement that the bidder must not involve subcontractors or suppliers linked to the Russian Federation under Regulation (EU) 2022/576 for more than 10% of the contract value.
