Compliance requirements
The machine-readable notice included the standard exclusion grounds for criminal organisation, corruption and fraud, and the bidder must confirm whether any of these grounds apply to the bidder or to persons representing or controlling the bidder. If an exclusion ground exists, the bidder may submit evidence of self-cleaning. The notice also refers to the possibility of checking the information electronically where available. The exact exclusion grounds and any detailed confirmations must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder's total turnover for the last three financial years must be at least EUR 125,000 excluding VAT. If the data are not electronically available, the bidder must submit the annual reports or extracts for the last three closed financial years showing the turnover.
The bidder, or the joint bidders as a whole, must have up to 2 properly performed infrastructure construction contracts completed within the last 60 months, with a total value of at least EUR 125,000 excluding VAT. The bidder must provide a short description of the contracts, the performance period, the client's contact details and the public procurement reference number, if available. If the contract data cannot be found in the eRHR, client confirmation letters may be added.
If the bidder uses subcontractors and relies on their capacity, a separate ESPD must be submitted for those subcontractors, and the subcontracting share must be stated as a percentage of the total contract value. The subcontractor's consent must also be provided.
The tender must comply with the procurement documents, be submitted in the required format and include all required documents and forms. If the bid is submitted by a person whose right of representation does not arise from law or cannot be verified in public registers, a power of attorney must be submitted. In the case of a joint bid, a power of attorney for the joint bidders' representative must be submitted. The bidder must also confirm compliance with the tender documents and, where necessary, explain equivalence and attach supporting evidence.
