Compliance requirements
The machine-readable notice lists criminal conviction-based exclusion grounds, including participation in a criminal organisation, corruption and fraud. The bidder or its management, administrative or supervisory body members, or authorised representatives must not have the relevant final convictions within the last five years, unless the exclusion period has expired. If an exclusion ground exists, the bidder may provide evidence of self-cleaning measures where allowed. The notice also refers to the possibility of checking the information electronically.
Qualification criteria and exclusion grounds
The bidder must submit the tender in accordance with the procurement documents and confirm that the tender complies with the technical specification. The tender must include the Appendix 1 technical specification tender form and the manufacturer’s technical data sheet that allows compliance to be verified. If an equivalent product is offered, evidence of equivalence must be provided, such as the manufacturer’s technical file, test reports from a recognised body, declarations or certificates, a comparison table, and product images and drawings. The tender price must be submitted in the required structure. In a joint tender, an authorised representative must be appointed and a joint tenderers’ power of attorney must be attached. The bidder must also confirm that the supplied goods are not subject to international sanctions and that it does not involve subcontractors or suppliers subject to sanctions for more than 10% of the contract value.
