Compliance requirements
The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, participation in a criminal organisation, or offences related to a terrorist act or terrorist activity. If such a ground applies, the bidder may submit evidence of self-cleaning measures where permitted. Subcontractor checks apply at the contract performance stage, and first-tier subcontractors must also submit the ESPD.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must be at least EUR 400,000; assuming the financial year follows the calendar year, this means 2025 and 2024. Within the 60 months before the publication date of the contract notice, the bidder must have properly performed at least one similar construction contract. A similar contract means a contract where the volume of construction work carried out in a building, part of a building or building complex was at least 2,000 m2. The bidder must submit a list of contracts with the names and contact details of the contracting partners, the subject of the contract, the closed net floor area and the contract period; if the contract was awarded through public procurement, the public procurement reference number must also be provided. The contracting authority may request a confirmation letter from the client that the works were performed properly. For the construction works, the bidder must involve a site manager who has at least the professional certificate “Construction Engineer, level 6” with specialisation in “Building construction” and the competence “Management of construction activities” or equivalent, or at least the professional certificate “Construction Manager, level 6”. The bidder must also involve a water supply and sewerage specialist who has at least the professional certificate “Water Supply and Sewerage Engineer, level 6” with specialisation in “Building water supply and sewerage” and the occupation “Management of construction activities” or equivalent, or at least the professional certificate “Construction Manager, level 6” with specialisation in the construction of in-building or adjacent water supply and sewerage systems or equivalent. Primary qualifications based only on education are not considered equivalent. For certificates issued in Estonia, the contracting authority checks the qualification in the public professional register; for certificates issued abroad, both the document from the competent authority and the document from the Estonian competent authority proving equivalence must be submitted. In a joint tender, an authorised representative must be appointed and a power of attorney and a statement of joint and several liability must be submitted. The tender must be submitted by taking over all conditions set out in the procurement documents, and the price must be provided both in the eRHR worksheet and in Form 3.
