Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that its business is not suspended, and that it has no tax debt or social security contribution debt. The bidder must also confirm that the average wage of its employees during the reference period was above 70% of the average wage for the same period in the relevant field, and that it is not a related party to the beneficiary’s technical consultant. In the case of a joint bid, these confirmations apply to each joint bidder. The exact verification procedure is described in the invitation to tender.
Qualification criteria and exclusion grounds
The bidder must have submitted a notice in the commercial register for the construction activity category covering general construction, indoor climate systems, and water supply or sewerage systems within a building or attached to it. For electrical works, the bidder must also have a notice for electrical works covering the construction and installation of electrical installations. For a foreign bidder, the commercial register requirement does not apply, but equivalent competence must be demonstrated. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must agree to provide a 5% performance security no later than at contract signature or within 10 calendar days thereafter. During the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT; the project had to involve erection, extension or full-building reconstruction and include at least load-bearing and external envelope works, heat-recovery mechanical ventilation, or a new heating system. Evidence must include the project details and either the use notice/use permit number or a copy of the handover-acceptance certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a competent person for electrical works; for each person, the name and professional/competence certificate number must be provided. A certified architect responsible for the project’s compliance with the European New Bauhaus requirements must also be included. The machine-readable notice did not include precise requirements; these must be checked in the tender documents.
