Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(3) and (5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, and that its business activities are not suspended. It must also have no tax, fee or environmental charge arrears, and no tax or social security contribution arrears. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the sector average for the same period and provide a Tax and Customs Board extract or an equivalent foreign authority certificate. In addition, the bidder must confirm that it is not a related party of the technical consultant advising the beneficiary on the apartment building reconstruction. In a joint bid, these confirmations apply to each joint bidder.
Qualification criteria and exclusion grounds
The bidder must have submitted a notice in the commercial register under the construction activity area covering general construction, indoor climate systems, and building-internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a notice under the electrical works activity area for the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the contract’s estimated value excluding VAT. By submitting the bid, the bidder must accept that by the contract date, or within 10 calendar days after signature, it must be able to provide a performance guarantee amounting to 5% of the contract value, or deposit the corresponding amount into the beneficiary’s or a notary’s account. Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the contract’s estimated value excluding VAT. An equivalent project means the erection, extension or full reconstruction of a building as the main contractor, including at least construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. The bidder must provide the building details, the time and value of the work, and proof in the form of a use notice, occupancy permit or handover-acceptance certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person qualified for electrical works; the project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification, the site manager a level 5 construction foreman qualification, the ventilation and heating specialist a relevant level 6 qualification or a level 6 construction manager qualification, and the water supply and sewerage specialist a relevant level 6 qualification or a level 6 construction manager qualification. For electrical works, the person must have at least a Class B competence certificate or a level 6 electrical engineer qualification. The team must also include a licensed architect at level 7 responsible for compliance of the construction project with the New European Bauhaus requirements. For foreign bidders, equivalent competence may be demonstrated. If team members are not employees of the bidder, their written consent must be attached. The bid must be submitted on the beneficiary’s form and comply with the procurement documents; conditional bids are not allowed. If equivalent solutions are used, they must be explained and supported by evidence. If the bid is submitted by an authorised representative or is a joint bid, the relevant powers of attorney must be attached.
