Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, and that its business activity has not been suspended. The bidder must also confirm that it has no outstanding state tax, fee or environmental charge debts, and no tax or social security contribution debts. In addition, the bidder must confirm that its employees’ average remuneration during the reference period exceeded 70% of the average remuneration for the same period in the relevant sector, and it must provide an extract from the Tax and Customs Board or an equivalent foreign authority. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. In the case of a joint tender, the exclusion grounds are checked for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must have submitted a notice in the Register of Economic Activities for the construction activity area covering general construction, indoor climate systems, and on-site or building-related water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering the construction and installation of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent competence must be demonstrated.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. By submitting the tender, the bidder must agree that by the contract date, or within 10 calendar days after contract signature at the latest, it can provide a performance security amounting to 5% of the contract value; acceptable forms include a bank or financial institution guarantee, deposit of the amount into the contracting authority’s account, or deposit with a notary.
Within the last 60 months, the bidder must have carried out at least one equivalent construction work with a value of at least half of the estimated contract value excluding VAT. An equivalent work means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing structures and external envelope, mechanical ventilation with heat recovery, and a new heating system. The bidder must provide the work name, time, value, and proof by means of an occupancy notice, occupancy permit, or handover-acceptance act.
The team must include: a project manager with at least level 6 construction engineer qualification or level 6 construction manager qualification; a site manager with at least level 5 construction foreman qualification; an HVAC specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification; a person performing electrical works with at least a class B competence certificate or level 6 electrical engineer qualification; and a chartered architect at level 7 responsible for ensuring the design’s compliance with the New European Bauhaus requirements. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. Equivalent competence is accepted for foreign bidders.
