Compliance requirements
The bidder must confirm the exclusion grounds, including participation in a criminal organisation, corruption and the other grounds listed in the ESPD. If any ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and any possible self-cleaning conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment; if there is no registration obligation, a copy of the founding agreement or an equivalent document must be submitted. At the time of submitting the tender, the maintenance team must include at least one maintenance engineer in Estonia who speaks and writes Estonian and has manufacturer training for servicing and repairing the offered device; copies of training certificates and the confirmation form in Annex 3, Form I, must be included. The bidder must be the official distributor of the offered products and must have the manufacturer’s authorisation for technical support in the Republic of Estonia; a manufacturer-issued original document or copy must be submitted as proof. The tender must include the bidder’s declaration in Annex 3, Form I, and, where necessary, a power of attorney, the technical specification with actual parameter values, manufacturer information, user manual, short description of the offered configuration, proof that the device is a medical device and bears the CE mark, proof of the risk class and electrical safety class, certificates and declarations of conformity to the required standards, and the warranty, maintenance and repair conditions. The warranty for the offered device must be at least 12 months, and the warranty for spare parts must be at least 6 months. The maintenance and repair price lists and the consumables price lists must remain valid for the entire contract period. The machine-readable notice did not include precise qualification or compliance requirements; these must be checked in the tender documents.
