Compliance requirements
The bidder must not be subject to the exclusion grounds set out in § 95(1) points 1–5 and § 95(4) point 12 of the Public Procurement Act. The bidder must confirm in the public procurement register that these exclusion grounds do not apply. If the company has other persons authorised to represent it, make decisions on its behalf or control it, and these persons are not visible in the commercial register, the bidder must provide their names and personal identification codes, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder must have at least one properly completed contract within the 60 months preceding the publication deadline of the contract notice, under which it carried out the construction of external water supply and sewer pipelines. The bidder must submit the contract details on the form provided by the contracting authority, a confirmation from the client that the contract was properly performed, a short description of the contract, the performance period, the other contracting party’s contact details, and, in the case of a public procurement, the reference number. A handover-takeover certificate for the construction works is not accepted as client confirmation. If the bidder relies on the capacities of another company, it must submit that company’s legal representative’s consent, and that company must participate directly in performing the contract to the extent relied upon. In the case of a joint tender, information must be provided on the size and nature of each joint tenderer’s share of performance. The bid must be signed by the bidder’s legal representative or an authorised person, and a power of attorney must be attached if needed. The bid must comply with the procurement documents; conditional bids are not allowed; and compliance with sanctions requirements, environmental conditions, equivalence and subcontractor replacement-related requirements must be confirmed.
