Compliance requirements
The bidder must confirm that neither it nor its management, supervisory or controlling body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other offences listed in the tender documents. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The bidder must also confirm that its place of establishment is not in the Russian Federation or the Republic of Belarus and that it does not involve subcontractors or suppliers representing more than 10% of the contract value who are linked to the Russian Federation in the way described by the sanctions rules. The exact exclusion grounds and confirmations must be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must confirm, for the bid to be compliant, that the bid meets all conditions set out in the procurement documents. The bid price must be submitted according to the required structure. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bidder must also indicate any trade secrets and justify the designation, or confirm that the bid contains no trade secrets. For contract performance, at least one lead expert must be named who meets the conditions in § 14(1) and § 34(4) of the Environmental Impact Assessment and Environmental Management System Act, and the expert’s first and last name plus the EIA licence code or number must be provided. In addition, where necessary, the names and personal identification codes of persons not visible in the business register must be provided so that exclusion grounds can be checked. The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents.
