Compliance requirements

The contracting authority will exclude a bidder from the procedure if any of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder. These grounds include, among other things, convictions for certain offences, illegal employment of foreign workers, tax debts, and sanctions violations. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must be entered in the business register of its country of establishment if this is required by the laws of that country, and must provide a copy of the relevant proof of registration where required. The bidder and/or its subcontractor must have performed at least one similar contract within the last 36 months before the start of the procurement, where the subject was the design of an industrial fuel feed technological object or system at the preliminary design, main design, or working design stage. A list of contracts must be submitted, including the contract name, short description, performance period, and the other contracting party. The bidder and/or its subcontractor must have qualified responsible persons for the works: a construction specialist with at least the professional qualification of Chartered Civil Engineer, level 7, specialising in building construction, and an electrical specialist with at least the professional qualification of Chartered Electrical Engineer, level 7, specialising in power networks and systems with design rights, or at least an A-class competence certificate with design rights. A foreign bidder must submit equivalent qualification and competence documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. In addition, the bidder must provide details of the specialist responsible for the technological part and automation part; that specialist must have experience within the last 36 months in at least one contract for the design of an industrial fuel feed technological object or system at the preliminary design, main design, or working design stage. If the bidder relies on the resources of another company, the subcontractor must be added to the subcontractors table. The exact forms and evidence must be checked in the tender documents.
