The bidder must confirm that none of the exclusion grounds set out in § 95(1) points 1–5 and § 95(4) points 3, 8, 9 and 11 of the Public Procurement Act apply. The bidder must also confirm that it has reviewed the instructions published on the contracting authority’s website and that none of the disqualification or exclusion grounds referred to in point 6.3 of Eesti Energia AS and its group companies’ procurement procedure apply.

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself. A foreign bidder must provide confirmation of registration in the commercial register or another equivalent register. If the exact qualification or suitability criteria need to be checked, the tender documents must be consulted.
