Compliance requirements

The exclusion grounds mainly concern final convictions for participation in a criminal organisation, corruption and fraud. The bidder, or members of its administrative, management or supervisory body, procurators or other persons authorised to represent it, must not have been convicted of these offences within the last five years if the exclusion period still applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice did not include any more precise exclusion grounds; these must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must confirm with the tender that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The bidder must also confirm that it has reviewed all relevant facts and conditions before submitting the bid, fully accepts the terms set out in the contract notice and tender documents, and submits a bid that fully complies with them. The bid must remain valid for at least 3 months from the submission deadline. If successful, the signed contract must be returned within 5 calendar days after receipt of the contract signed by the contracting authority. The bidder must not be linked to the contracting authority in a way that creates a competition-distorting conflict of interest. The bidder must also confirm that it has the right to resell Oracle licences in the territory of the Republic of Estonia and that it is Oracle’s technical cooperation partner; relevant evidence must be provided. If the bid is submitted by an authorised representative, a document proving the authority to represent must be submitted. In a joint bid, the joint bidders’ power of attorney and the ESPDs for all joint bidders must be submitted. Where necessary, the bidder must also provide details of management persons not visible from the Commercial Register so that the exclusion grounds can be checked. The machine-readable notice did not include any other precise selection or compliance requirements; these must be checked in the tender documents.
