Purchase of negative pressure wound therapy systems

Summary

The tender concerns a framework agreement for the purchase of up to five new negative pressure wound therapy systems, post-warranty maintenance services until the end of the contract, repair work and spare parts after the warranty period until the end of the contract, and, if needed, single-use consumables during the contract period. The bidder must submit the required tenderer declaration, technical description of the offered device, manufacturer information, user manual, proof of CE marking and medical device conformity, warranty terms, maintenance and repair price lists, and confirmation that the device is new and unused. The maintenance team must include at least one service engineer in Estonia who speaks Estonian and has manufacturer training for servicing and repairing the device.

Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. The bidder or members of its management bodies must not have been finally convicted of these offences within the last five years, or the disqualification period stated in the conviction must have expired. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For some grounds, the date of conviction, the reason, the convicted person and the duration of exclusion must also be stated, and it must be indicated whether the information is electronically available.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment. If the bidder is not required by law to be entered in such a register, it must submit a copy of the founding agreement or an equivalent document. The bidder must be an official distributor of the offered products and have the manufacturer’s authorisation for technical support in Estonia. The bidder must submit the relevant original document(s) issued by the manufacturer or copies thereof. If the bidder plans to use subcontractors for part of the framework agreement, it must state the share of the contract to be subcontracted and identify the subcontractors involved in direct performance. If relevant, a separate ESPD must be submitted for subcontractors relied on for performance.
