Compliance requirements

The exclusion grounds mainly cover participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, and the use of child labour and other forms of human trafficking. The bidder or the members of its management, governing or supervisory body, procurators and other persons authorised to represent it must answer yes/no questions on these grounds and, where required, provide the date of conviction, the reason, the convicted person, the duration of exclusion and a description of any self-cleaning measures. If an exclusion ground applies, the bidder may submit evidence of remedial measures where this is allowed in the procurement. The exact exclusion grounds and required answers must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have completed at least 2 contracts in the 24 months before publication of the procurement, covering the supply, installation and maintenance of similar equipment. The contracting authority considers physiotherapy and rehabilitation equipment to be similar equipment. The total value of these contracts must be at least EUR 30,000 excluding VAT. With the tender, the bidder must submit short descriptions of the completed contracts, the contract conclusion and performance dates, and the client details. For public contracts, the reference number of the procurement must be stated. The contracting authority may ask the other party to the contract to confirm performance. If the bidder relies on the resources of another undertaking, a signed consent from that undertaking must be submitted on the prescribed form and the other undertaking must also be added in the system as a subcontractor or as the undertaking/person whose capacities are relied on. The tender must also include the user manual and technical documentation of the offered equipment, showing how the equipment is used and its technical characteristics so that the contracting authority can verify compliance with the tender documents. If the bidder participates jointly, a joint-bid power of attorney and a free-form statement of each joint bidder's share and role must be submitted. The bidder must confirm that the tender complies with the tender documents and, where necessary, that equivalence has been explained and supporting evidence has been added. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
