Compliance requirements
The bidder must confirm that neither the bidder nor its members of the management, administrative or supervisory bodies, procurists or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where this is allowed for the procurement.
By submitting the bid, the bidder also confirms that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act, and that the offered goods are not the object of international sanctions and do not originate from sanctioned areas. If the bid is conditional or does not comply with the tender documents, the contracting authority may reject it.
Qualification criteria and exclusion grounds
The bidder must have completed at least 1 public bridge construction contract as the main contractor during the 60 months before the contract notice publication date, where the bridge built or reconstructed had an opening length of at least 25 metres. The contract is considered completed when the works have been carried out and the client has accepted the object; the warranty period may still be running.
The bidder must provide in the ESPD the contract details, including the contract object, a short description of the work and scope, the contract period and information about the other contracting party. For public contracts, reference numbers must be shown. On request, the successful bidder must also provide confirmation from the other contracting party that the contract was performed properly.
The bidder must appoint a project manager whose professional qualification is at least civil engineer, level 6 in construction management according to EQF, or equivalent, or road engineer, level 6 in construction management according to EQF, or equivalent. If the specialist’s qualification was obtained outside Estonia, the bidder must submit proof of the qualification together with an Estonian translation. The bidder must enter the project manager’s name, qualification, document number, issue date and issuing body in the ESPD. On request, the successful bidder must submit the project manager’s CV in the form required by the tender documents, signed by the project manager.
