Compliance requirements
The bidder and its management must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or offences related to terrorist acts or terrorist activity. If such an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted. The machine-readable notice did not include more detailed exclusion grounds; the remaining details must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts for the renovation or construction of children's playgrounds within the last five years (60 months), with a total value of at least EUR 25,000 excluding VAT. The bidder must provide contract details in the ESPD, including the contract value, dates, a short description of the subject matter, and information about the other contracting party (name, contact person, contact details); for a public procurement contract, the reference number. If subcontractors are used, the bidder must state the percentage share of subcontracted work in relation to the total contract value and submit the subcontractor consent form required by the tender documents. The bidder must also submit a power of attorney if the person signing the tender does not have authority by law or from public registers, and a joint tender power of attorney if the tender is submitted jointly. The tender must be complete, include all required documents and forms, and the price must be submitted in euros both without VAT and with VAT to two decimal places in the structure required by the pricing form. The bidder must confirm that the tender complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence has been attached.
