Compliance requirements

The bidder must confirm that neither the bidder nor the members of its management, supervisory or control bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or offences related to a terrorist act or terrorist activity. If such a ground applies, the bidder may submit evidence of self-cleaning measures where allowed by the tender documents. The notice also requires confirmation that the bidder will not use a subcontractor who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act (RHS).

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, as main contractor or as a subcontractor carrying out or organising all construction works: 1) fully built or fully reconstructed at least 10 km of drainage ditches of a land improvement system under a construction project, or 2) fully carried out renewal or maintenance of a land improvement system for at least 20 km of drainage ditches, including brush cutting/mowing on ditch banks, removal of vegetation, flow obstructions and sediment from watercourses and sedimentation basins, or 3) built at least 20 earth dams to block water flow and prevent soil erosion in bog or mire water-regime restoration works under a construction project. If the bidder relies on the capacities of another company, the bidder must submit that company’s details and consent. The bidder must also provide the details of at least 1 relevant completed works contract in the ESPD, and if the contract was awarded through public procurement, also the procurement reference number. For subcontractors, the notice says first-tier subcontractors are checked, but they do not need to submit an ESPD.
