Compliance requirements
The contracting authority will exclude a bidder if a mandatory exclusion ground under Section 95(1) of the Public Procurement Act applies. The contracting authority may also exclude a bidder if a ground under Section 95(4) applies. When submitting the tender, the bidder must confirm that no exclusion grounds apply. Before contract award, the contracting authority will verify the absence of at least the grounds listed in Section 95(1) on the basis of evidence provided by the bidder.
Qualification criteria and exclusion grounds
The bidder must have a valid operating licence on the date of submission for providing outpatient obstetrics and gynaecology services, or outpatient gynaecology services, or obstetrics and gynaecology services, at the place where the service will be provided. The bidder must state the licence number(s) in the tender form and confirm that the service will be provided in the premises on which the licence was issued.
The bidder’s 2025 net turnover from healthcare services must be at least EUR 106,171. The required turnover is calculated for one doctor working full-time in outpatient care and increases proportionally with the number of doctors and workload offered.
In the 12 months before the month in which the decision to announce the procurement was made, the bidder must have provided outpatient gynaecology services at least 50 times. The bidder must confirm this experience in the qualification form.
For the offered specialty, the bidder must have provided e-consultations during the 12 calendar months before the month of the procurement announcement decision, or must be ready to provide e-consultations through the health information system by the tender deadline. This applies only where such e-consultation is required by law, except for haemodialysis, infertility treatment and preventive services.
The bidder must have a working ultrasound device at each service location offered on the submission date, with the ability to perform vaginal and rectal ultrasound examinations. The bidder must provide the service locations in the qualification form and attach copies of documents proving purchase, lease, rental, free use or other acquisition of the device, as well as a photo showing the device’s unique serial number and model. A prior agreement is not sufficient.
