Compliance requirements
The contracting authority will exclude a bidder if a ground for exclusion under Section 95(1) of the Public Procurement Act applies. The contracting authority may also exclude a bidder if a ground under Section 95(4) applies. When submitting the bid, the bidder must confirm that no exclusion grounds apply. Before signing the contract, the contracting authority will verify the absence of the exclusion grounds referred to in Section 95(1) on the basis of evidence. In addition, the bidder must confirm that it will not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the sanction rule, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
Qualification criteria and exclusion grounds
The bidder, including each joint bidder in a joint bid, must hold an operating licence for outpatient ophthalmology services at the place where the service will be provided on the day the bid is submitted. The licence must cover the locations where the bidder will actually provide the service, and the licence number(s) must be entered in the bid form. The bidder must also show a 2025 net turnover from healthcare services of at least EUR 143,261; this amount is calculated per one doctor working full-time in outpatient care and increases proportionally with the number of doctors and their workload in the bid. In the 12 months before the month in which the contract notice decision was made, the bidder must have provided outpatient ophthalmology services at least 50 times. For e-consultations, the bidder must either have provided e-consultations in the relevant specialty during the previous 12 calendar months or, by the bid deadline, be ready to provide e-consultations through the health information system, where this is required by law. The bidder must submit the required confirmations in the procurement register and, where applicable, the bid form and supporting documents listed in the tender documents.
