Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds listed in clauses 1 to 5 of section 95(1) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the company. These grounds include participation in a criminal organisation, corruption, fraud, terrorism, money laundering, unlawful employment of foreign nationals or breach of foreign workers’ employment conditions, illegal use of child labour or human trafficking, tax or social security debt, and breach of sanctions. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must have completed at least one design contract of similar complexity and scope to the subject of the procurement during the 36 months before the start of the procurement. The bidder must submit a list of the main completed design contracts, with information on their value, dates and the other contracting parties, using the required form. The bidder must also have qualified responsible persons for the design work, including at least one designer with professional qualification as a chartered architect at level 7 or equivalent or better, with competence in the architectural part of a construction project, including exterior and interior design solutions at all project stages, and at least one designer with professional qualification as a chartered civil engineer at level 7 or equivalent or better, with competence in preparing a building construction project or managing design. Copies of documents proving the qualifications and competence of the responsible persons must be submitted. A foreign bidder without documents issued under Estonian rules must submit copies of qualification and competence documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
