Compliance requirements
The exclusion grounds include, among others, participation in a criminal organisation, corruption, fraud, and offences related to terrorist acts or terrorist activity. If such a ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice listed the exclusion grounds, but the full check must be made in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment in accordance with the law of that country. A bidder established outside Estonia must submit a copy of the registration certificate issued under the law of its country of establishment, dated no more than 30 days before the tender submission deadline. For bidders established in Estonia, the contracting authority checks the registration and valid data itself from public registers. The tenderer must also confirm that the tender complies with the tender documents, that any required equivalence has been explained and supporting evidence attached, and that the price form is completed in the required structure. For the furniture, the bidder must confirm that only legally harvested wood from legal sources is used and provide proof of origin upon handover; suitable proof includes an FSC certificate or a FLEGT or CITES licence. The bidder must declare any REACH candidate-list substances present above 0.1% by weight in the product or any component/material and provide evidence of such substances or their absence upon handover. The bidder must also confirm that the furniture can be disassembled with hand tools and parts replaced by an untrained person, and submit disassembly and repair instructions. The warranty for the furniture must be at least 2 years and must cover repair and replacement items during warranty repairs. Spare parts or equivalent functional elements must be available for at least two years. If the bid is a joint tender, a power of attorney from the joint bidders' authorised representative must be attached. The tenderer must submit the required technical specification for the offered products and, where relevant, product catalogues or other product documents.
