Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither it nor its persons with representation rights have been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, financing of terrorism, illegal employment of foreign nationals, or human trafficking-related offences. The bidder must also confirm that it has no tax debt and that entering into the contract would not breach an international sanction or a sanction of the Government of the Republic of Estonia. If the bid is submitted together with a foreign company or relies on foreign subcontracting/support, the bidder must provide evidence of the absence of exclusion grounds upon the contracting authority’s request.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 6,000,000 excluding VAT, with at least EUR 2,000,000 in each year. If the bidder relies on the capacities of another entity, it must submit that entity’s written confirmation, consent to reliance, an explanation of how it will participate in contract performance, and confirmation of joint liability. If the bidder is a foreign company or the data cannot be verified from public registers, extracts from annual reports or other evidence must be provided. For technical capability, the bidder must have properly performed at least two contracts for the construction of substations at 110 kV or higher within the last 60 months, including design and the construction of relay protection and automation. Each contract must have a value of at least EUR 300,000 excluding VAT, and at least EUR 300,000 excluding VAT must have been paid to the bidder under each contract. The bidder must also provide reference contract details and, upon request, the client’s confirmation or other evidence. When submitting the bid, a power of attorney must be provided if the signatory is not a statutory representative; in a joint bid, a joint bidders’ power of attorney and confirmation are required. A bid security of EUR 37,000, a price table, substation schematics, a financing and work schedule, completed questionnaires, and a team CV must also be submitted. The offered equipment must be new, unused, defect-free, and comply with the technical requirements.
