Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, or for any other exclusion grounds listed in the tender documents. If such a ground exists, the bidder may in certain cases submit evidence of self-cleaning measures to restore reliability. The ESPD also asks for confirmation of payment of taxes and social security contributions and whether the information is electronically available. The exact exclusion grounds and any possible evidence must be checked in the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. The ESPD includes general declarations, such as whether the bidder is listed in an official register of approved economic operators, whether the bid is a joint tender, whether the bidder relies on the capacities of other entities, and whether subcontractors are used. If any of these situations apply, the relevant details and evidence must be provided. The compliance conditions require the bidder to confirm that the bid complies with the tender documents, submit the completed participation application form, the completed Annex 1 product list and unit prices, the technical specification form, and the manufacturer’s technical data sheet. For the offered operating textiles, the bidder must provide the manufacturer’s technical information and documents proving compliance. All offered operating drapes must comply with EN 13795:2019; the products must be marked either EN 13795 SP or EN 13795 HP, and products intended for longer operations and/or operations with a high fluid load must meet EN 13795 HP. Where applicable, the bidder must submit the manufacturer’s declaration of conformity and, if required by law, an EC/EU certificate of conformity or another document proving compliance. The bid must also include complete samples for all lots in original packaging, at least 1 piece for each offered product, and the packaging must show the product name, lot number, procurement title, reference number and bidder name. In the case of a joint tender, a power of attorney must be attached. The bidder must also identify any trade secrets and justify their designation.
