Compliance requirements
The machine-readable notice includes mandatory exclusion grounds such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and other similar conviction-based grounds. If an exclusion ground applies, the bidder may be allowed to show self-cleaning measures where the procurement rules permit it. The exact grounds and any self-cleaning details must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must hold, by the time the service contract is signed, an operating licence under section 8 of the Food Act issued by the Agricultural and Food Board. The contracting authority may verify the licence in a register or request evidence before contract award. In the ESPD, the bidder must confirm that it is ready or able to obtain the licence. In addition, the bidder must have, during the 36 months preceding the start of the procurement, at least 2 properly performed or ongoing catering service contracts in a kindergarten or general education school, each worth at least EUR 50,000 excluding VAT. The bidder must provide the contract value, signing date and details of the other contracting party. The tender must comply with the tender documents, and the bidder must submit Annex 6, the price schedule, and Annex 8, the confirmation of inspection of the premises. In the case of a joint tender, a joint bidders’ declaration and power of attorney must be attached.
